FORT HOOD -- The defense attorney for Major Nidal Hasan, accused of shooting and killing 13 people at Fort Hood, has decided to step down.

This afternoon was Hasan's first court appearance since news broke he will face the death penalty.

Before the arraignment a major announcement Hasan has dropped his lead defense attorney John Galligan and will now be represented by Colonel Kris Poppe.

Officials say the defense requested a delay in the trial date and since the government did not oppose the request was granted.

"The judge explains, that the defense requested delay until March 5, 2012, is granted and that case will be docketed for that day," said Thomas Rheinlander, Fort Hood Public Affairs Officer.

Hasan waived reading of the charges and deferred entering a plea.

He's presumed innocent until proven guilty in a court of law.
