Daycare owner indicted on murder, child endangering charges

Waco, Texas — A Waco daycare owner has been indicted on murder, injury to a child causing serious bodily injury, and endangering a child charges.
Marian Bergman Fraser, 50, is charged with one count of murder and one count of injury to a child causing serious bodily injury on one indictment. Ten seperate indictments also charge Fraser with one count each of endangering a child.
Fraser was arrested in August 2013 after a child died under her supervision earlier in the year.
Police say on March 4, 2013, Waco Police Department officers were called to Providence Hospital about a child death. After arriving, police learned 4-month-old Clara Margurite Felton, of Waco, had been taken there by ambulance when workers at the Spoiled Rotten Daycare found the baby unconscious and not breathing around 2:50 p.m.
Precinct 1 Justice of the Peace Kristi DeCluitt pronounced the child dead and ordered an autopsy. The baby was sent to Dallas where results showed the girl had died from a "Toxic Level" of Diphenhydramine (Benadryl) in her system.
Following that arrest, Fraser posted bond and was released. Several days later, eight additional warrants were issued for the arrest of Fraser. Those warrants charged Fraser with Endangering a Child. Special Crimes Detectives requested the warrants after eight additional children tested positive for the drug Benadryl. Fraser was then booked into the McLennan County Jail again on those charges.
