Grand jury choses not to indict man on capital murder for shooting, killing deputy
DALLAS, TX — A grand jury decided not to indict a Central Texas man on capital murder for the shooting death of a sheriff's deputy.
Henry Goedrich Magee was arrested for killing Burleson County Sergeant Adam Sowders while officers were serving a search warrant at Magee's home in December 2013. According to reports, Magee claims he thought his home was being broken into, so he grabbed his gun and opened fire. Reportedly, the officers did not announce themselves when they were entering the home.
Magee was, however, indicted on possession of marijuana while in possession of a deadly weapon, which is a third degree felony.
