Man arrested for sexually assaulting sleeping victim

A Temple man is still in jail, following his arrest on Monday on sexual assault charges.

Earnest Tyrone Burnett, 36, is being held on a $25,000 bond.

Police say on June 28, 2013, they responded to a sexual assault call in the 1400 block of Canyon Creek Drive. The victim reported being at the residence with a subject, known to the victim as Earnest Burnett. During the evening hours the victim reported falling asleep and upon waking up, found the suspect engaged in a sexual act with the victim without consent.

The case was reviewed by the Bell County District Attorney’s Office and a complaint against Burnett was issued by that office on February 21. Investigators from the Temple Police Department’s Investigations Unit obtained an arrest warrant from Justice of the Peace G.W. Ivey the same date. 

A patrol officer was dispatched to the Pardons and Parole office in reference to a warrant service. Upon arrival the officer found Burnett inside the building and took him into custody without incident on March 17.
