(CNN) — Texas Judge Darlene Byrne ruled on Monday that a $3 million lawsuit can proceed against Lance Armstrong.
Armstrong and his attorneys had requested the lawsuit be dismissed on May 24. Nebraska-based Acceptance Insurance awarded Armstrong the bonuses for winning the Tour de France from 1999-2001 according to Acceptance's Attorney Mark Kinkaid.
Kinkaid went on to say they company is also seeking attorney's fees and interest.
"We are pleased with the court's ruling and looking forward to proceeding...we would like to interview Armstrong as soon as possible...Lance Armstrong would be the number one witness," said Kinkaid.
CNN reached out to Armstrong's representative, Mark Fabiani, to request a statement and Fabiani replied via email saying, "No sorry."
